Kitten Sales Terms & Conditions

These Terms & Conditions form part of the sale agreement between Marybank Maine Coons ('the Breeder') and the purchaser ('the Buyer').

1. Reservation & Deposits

A deposit is required to reserve a kitten.

Deposits are non-refundable unless Marybank Maine Coons is unable to supply the reserved kitten.

Deposits may be transferred to another available kitten or future litter at the breeder's discretion.

The remaining balance must be paid in full before collection.

2. Collection

Kittens will not leave Marybank Maine Coons before they are at least 12 weeks of age unless agreed otherwise.

Before collection every kitten will have received:

·        Two FVRCP vaccinations

·        Microchip

·        Desexing

·        Worm treatment

·        Veterinary health examination

Ownership transfers once full payment has been received.

3. Health Guarantee

Every kitten is examined by a registered veterinarian before leaving Marybank Maine Coons.

To the best of our knowledge, every kitten is healthy at the time of collection.

Our Health Guarantee covers serious congenital or hereditary conditions that become apparent within the applicable guarantee period and significantly affect the kitten's quality of life.

If a qualifying condition is confirmed by a registered veterinarian, Marybank Maine Coons may provide one replacement kitten at our discretion.

The Health Guarantee does not cover:

·        Infectious diseases contracted after collection.

·        Parasites contracted after collection.

·        Injuries or accidents.

·        Poisoning.

·        Diet or nutrition-related conditions.

·        Environmental factors.

·        Neglect or abuse.

·        Failure to seek prompt veterinary treatment.

·        Routine veterinary expenses.

·        Cosmetic defects that do not affect the cat's quality of life.

4. Buyer's Responsibilities

The Buyer agrees to:

·        Provide appropriate nutrition.

·        Provide fresh water at all times.

·        Maintain routine veterinary care.

·        Keep vaccinations current as recommended by their veterinarian.

·        Maintain flea and worm prevention.

·        Provide a safe indoor home or secure outdoor enclosure.

·        Contact Marybank Maine Coons if serious health concerns arise.

5. 12-Month Peace of Mind Cover (Premium and Platinum Packages Only)

Marybank Maine Coons will provide one replacement kitten if the kitten passes away unexpectedly within 12 months of collection or the kitten is stolen.

The cover applies only to the original purchaser, is non-transferable, is limited to one replacement kitten, is valid for 12 months from collection, and is subject to kitten availability.

If the kitten passes away unexpectedly, the Buyer must provide a veterinary certificate confirming the death and any additional information reasonably requested.

The cover does not apply where death resulted from neglect, abuse, poisoning, intentional harm, failure to seek veterinary treatment, or preventable injury.

If the kitten is stolen, the theft must be reported to New Zealand Police and a copy of the Police report provided.

Transport costs for replacement kittens remain the responsibility of the Buyer.

6. Lifetime Breeder Support

Marybank Maine Coons is committed to every kitten for life.

If at any stage the Buyer can no longer care for their cat, they agree to contact Marybank Maine Coons before rehoming, surrendering or selling the cat.

Marybank Maine Coons will accept the return of one of our cats or assist in finding a suitable new home.

This commitment helps ensure no Marybank Maine Coon bred by us enters a shelter or rescue organisation.

7. Veterinary Care

Following collection, all ongoing veterinary costs become the responsibility of the Buyer.

Marybank Maine Coons is not responsible for veterinary expenses incurred after collection unless otherwise required under New Zealand consumer law.

8. Limitation of Liability

Except where required by law, Marybank Maine Coons' liability is limited to the remedies outlined in these Terms & Conditions.

9. Amendments

Marybank Maine Coons may update these Terms & Conditions from time to time. The version in effect at the time of purchase will apply to that sale.

10. New Zealand Consumer Law

Nothing in these Terms & Conditions limits or excludes any rights the Buyer may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other applicable New Zealand legislation.
